1. Acceptance of Terms

By accessing or using Masco ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. These terms are governed by French law.

2. Description of Service

Masco is an AI-powered mascot generation platform that allows users to create mascot images and animations for their applications and brands. The Service includes image generation, animation creation, and API access for programmatic integration.

3. Account Registration

To use the Service, you must:

  • Create an account with accurate information
  • Be at least 18 years old or have parental consent
  • Keep your account credentials secure
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Credits and Payments

The Service operates on a credit-based system:

  • Free accounts receive a limited number of credits
  • Additional credits can be purchased through subscription plans
  • Payments are processed securely via Stripe
  • All prices are displayed in Euros and include applicable taxes
  • Subscriptions automatically renew unless cancelled

Refunds: You may request a refund within 14 days of purchase if you have not used the purchased credits, in accordance with French consumer law.

5. Intellectual Property Rights

Generated Content

All mascots, images, and animations generated through the Service are owned by Masco. However, you are granted a perpetual, worldwide, non-exclusive license to use, modify, and distribute the generated content for any purpose, including commercial use.

Your Rights

  • Use generated mascots in your products, apps, and marketing
  • Modify and adapt the generated content
  • Use commercially without additional fees
  • No attribution required (though appreciated)

Our Rights

Masco reserves the right to use generated content for promotional purposes, service improvement, and training our AI models.

6. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, or offensive content
  • Infringe on third-party intellectual property rights
  • Attempt to reverse-engineer or exploit the Service
  • Overload or disrupt the Service infrastructure
  • Share account credentials with unauthorized users
  • Circumvent usage limits or credit systems

Violation of these terms may result in immediate account termination.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will notify users of planned maintenance when possible.

8. Limitation of Liability

To the maximum extent permitted by French law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the last 12 months
  • We are not responsible for third-party services or integrations

These limitations do not affect your statutory rights as a consumer under French law.

9. Termination

By You: You may cancel your account at any time from your account settings. Unused credits from paid plans are non-refundable after the 14-day withdrawal period.

By Us: We may suspend or terminate your account for violation of these terms, with notice where possible. In case of serious violations, termination may be immediate.

10. Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

11. Governing Law and Disputes

These terms are governed by French law. Any disputes shall be submitted to the competent courts of France.
